בית־הקברות היהודי החדש. הקהלה ערערה ב־31/3
1856 נגד התביעה, וטענה, שהיהודים מהווים שליש
מן האוכלוסיה בלבוב וכמשלמי־מסים הם משתתפים
בכל ההוצאות להחזקת רבועי העיר, ולא מן היושר
הוא לדרוש מהם פיצויים בעד קרקע שהוא רכוש כל
העיר ותושביה. בכל זאת הכריע הנציב גולוחובסקי,
בהסתמכו על 22 § של תקנון היהודים מ־7 במאי
1789, שעל הקהלה לשאת בכל ההוצאות הקשורות
בהקמת בית־העלמין. אמנם, אין העיריה רשאית לתת
מאדמותיה לפרט או לצבור שום קרקע בלי פיצויים
כספיים תמורתה. טענת השיתוף של היהודים ברכוש "
העיר נדחתה לפי שאין הקהלה חלק מן העיר, והיא
קיימת בהנהלתה העצמאית, גובה תשלומים בעד
