הזמן והתנאים נראו להם נוחים לפעולה זו מאז
נתן הקיסר פראנץ 1, בשנת 1803, הוראות לעבד תקנון
יהודי חדש, ש״מטרתו אינה רק עניני מסים בלבד "

במשך שנים טיפלו השלטונות בהכנת התקנון החדש,
כי לפי דברי הקאנצלר גראף אוגארטה (1812) טעונה
שאלת היהודים עיון ממושך, אע״פ שהקיסר ביקש
להחיש את הענין. בשנת 1820 ציווה הקיסר בנימה
חריפה לפעול למען הסרת המחיצה שבין היהודים
ויתר האוכלוסין, ודרש להטיל על הנוער את חובת
הלימוד בבתי־הספר הכלליים ולהתנות את מינוי
